First and foremost, we are trial lawyers. In civil and criminal legal circles across the country, Rusty Hardin & Associates has built a solid reputation for establishing rapport with juries and obtaining favorable results for our clients.

In the words of Rusty Hardin, "There is no issue too complicated for a jury to understand. There are simply too many lawyers and witnesses who make it that way."

We can take a complex case and simplify it, giving it a voice that jurors can relate to. We know how to present the facts and evidence while keeping the jurors' interest and attention.

Though we are unstinting in our praise of and desire to appear before juries, we readily acknowledge that a reasonable settlement is often a more satisfying solution.

Our belief in juries is important for two reasons. First, juries sense that we believe in and trust them, and our ability to communicate with them increases the likelihood of success for our clients. Just as importantly, our opponents' recognition of our record of success with juries greatly enhances the settlement potential of a case in a way that frequently makes a trial unnecessary.

We are a diverse legal team with years of courtroom experience, both state and federal. We are experienced in the preparation and presentation of a wide variety of cases, and we handle all appeals.

Our practice is unusual in that it is both a civil and criminal practice. It is, however, based on a unified belief that juries are the same whether they are hearing civil or criminal cases.

Though our practice has increasingly been devoted to civil cases, we have steadfastly continued to represent people in criminal cases because we believe in it and enjoy it. For the last several years, our practice has been comprised of approximately eighty percent civil work and twenty percent criminal defense work.

As an example, in 2001, we went from a five-month trial in which we successfully defended the estate of J. Howard Marshall against the attacks of Anna Nicole Smith and Mr. Marshall's oldest son to representing Arthur Andersen in defending it against civil class actions and being lead counsel in its federal criminal trial. Soon after, we represented a plaintiff against a public university in a civil whistleblower lawsuit. The successful resolution of that case was followed by a five-week federal health care fraud criminal trial in which we obtained a verdict of "not guilty" for our physician client.

When asked what type of practice we have, Rusty has said, "We are all over the ballpark representing people and institutions that have a problem in civil and criminal courts." We love the variety and believe that the eclectic nature of our trial practice actually reinforces our ability to be of help to a broad cross-section of individuals and companies.
