Kent McMahan has three decades of experience in the law of trusts and estates. Certified in Estate Planning and Probate Law by the Texas Board of Legal Specialization for many years, he focuses on the representation of trust fiduciaries and beneficiaries, counseling corporate fiduciaries on fiduciary law and practice and advising individuals on the use of trusts for estate planning and wealth transfer.

A partner with Fulbright & Jaworski L.L.P. since 1978, Kent has helped improve the legal system for individuals using trusts in estate planning; for example, he participated in the drafting of the codification of Texas trust law and served as an advisor to the national drafting committee for the Uniform Trust Code.

Additionally, Kent advises clients in private wealth matters and has specific skills in representing clients who own closely held businesses in counseling on a number of issues, including choice of form, business succession and tax for planning for business owners. He is knowledgeable on the formation and operation of family limited partnerships and limited liability companies as well as tax planning in the transfer of interests in such entities.

Kent's clients, many of whom have sought his counsel for several decades, appreciate his clearly communicated advice, personalized service, and sharp focus on their current and future needs.

Representative individual clients with whom he maintains relationships include prominent senior executives in public and private corporations, non-profit entities, entrepreneurs, business owners, and members of the professional services industry, including doctors, lawyers, accountants and consultants.

He has represented in estate and trust matters most major financial institutions providing fiduciary services in and around the City of Houston.

REPRESENTATIVE EXPERIENCE

Representative matters Kent has handled include:
* Representation of the financial institutions providing trust services and other banks and trust companies.
* Counseling fiduciaries of non-profit entities in fulfilling responsibilities, including serving as board member on numerous foundations.
* Accomplishing numerous transactions involving complex estate planning transfers of wealth, such as uses of limited partnerships, gifts, intra-family sales, and private annuities. Reached successful conclusions for such transactions with minimal controversy with tax authorities.
* Assisting clients in making philanthropic gifts, including the creation of foundations and charitable split interest trusts.
* Advising clients in contested probate and trust matters and serving as a substantive law expert in support of trial attorneys' services, both inside and outside the firm.
