Creditors' Rights and Collections

The attorneys of Wells & Cuellar have broad and extensive experience representing a wide variety of business and institutional creditors, collecting money and protecting claims. Our activities include collecting judgments, commercial and consumer collections, foreclosures, deficiency suits, and other creditor remedies, Uniform Commercial Code matters, contractual and statutory liens, lien priority disputes, and creditors' rights in bankruptcy. We are experienced in representing creditors' interests in both liquidation (Chapter 7) and reorganization (Chapter 11 and Chapter 13) proceedings in the Bankruptcy Court, including protecting claims and collateral, defending preferences, and other litigation matters unique to the bankruptcy environment such as non-dischargeability, stay modification, and plan confirmation.

Since 1980, Brent has been actively engaged in a commercial litigation practice which has emphasized creditor's rights, collections, defense of consumer claims, and resolution of business disputes. Brent is nationally certified as a Creditors' Rights Specialist by the American Board of Certification and is also Board Certified in Consumer and Commercial Law by the Texas Board of Legal Specialization.

Brent is an advocate for institutional parties in various industries, such as manufacturing, retailing, energy, advertising, and finance. In addition to representing his clients in the state and federal trial and appellate courts, Brent is also available as a neutral mediator and arbitrator of commercial, debtor/creditor, and consumer issues which are submitted to him by parties who choose out-of-court alternatives to litigation.

Brent is frequently called upon as a seminar trainer and speaker by groups such as the National Association of Credit Management, the Texas Society of CPAs, the Texas Manufactured Housing Association, the National Petroleum Energy Credit Association, and the International Energy Credit Association. He has authored materials and presented hundreds of educational programs on topics such as Creditors' Rights in Bankruptcy, Successful Judgment Collection, Defending Against the Texas Deceptive Trade Practices-Consumer Protection Act (DTPA), and the Pros and Cons of Consumer Arbitration.
